Welcome to Blue Devil Jiu Jitsu. By accessing our website, registering for classes, or using our facilities, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully before using our services.

1. Acceptance of Terms

By registering for classes, participating in programs, or using our facilities, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.

2. Eligibility and Membership

Age Requirements

• Participants must meet age requirements for their respective programs
• Minors (under 18) must have a parent or legal guardian sign all registration and waiver forms
• Parents/guardians are responsible for minors' conduct and compliance with facility rules

Membership Registration

• All members must complete a registration form and sign a liability waiver
• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account information
• Membership is non-transferable

3. Payment and Billing

Fees and Payment

• Membership fees, class fees, and other charges are due as specified during registration
• We accept payments via credit card, debit card, or other approved methods
• All fees are non-refundable unless otherwise stated in our refund policy
• Prices are subject to change with 30 days' notice

Cancellation and Refunds

• Membership cancellations must be submitted in writing at least 30 days before the next billing cycle
• No refunds will be issued for partial months or unused class sessions
• Free trial periods do not require payment but require registration and waiver completion
• If you fail to cancel within the notice period, you will be charged for the following billing cycle

4. Facility Rules and Code of Conduct

All members and visitors must adhere to the following rules:

• Respect: Treat instructors, staff, and fellow members with respect and courtesy
• Safety: Follow all safety instructions and guidelines provided by instructors
• Hygiene: Maintain proper personal hygiene; clean training attire and short fingernails/toenails are required
• Equipment: Use equipment properly and return it to designated areas
• No Shoes on Mats: Remove shoes before stepping onto training mats
• Controlled Training: Train at an appropriate intensity level for your skill and your partner's safety
• No Tolerance for Bullying or Harassment: Any form of harassment, bullying, or inappropriate behavior will result in immediate termination of membership

5. Health and Safety

Assumption of Risk

Brazilian Jiu Jitsu and MMA training involve physical contact and carry inherent risks, including but not limited to:

• Bruises, cuts, sprains, and strains
• Broken bones or dislocations
• Concussions or other head injuries
• Serious injury or death (in rare cases)

By participating, you acknowledge these risks and voluntarily assume full responsibility for any injuries or damages sustained.

Medical Clearance

• You are responsible for ensuring you are physically and medically fit to participate
• Consult a physician before beginning any new physical training program
• Inform instructors of any medical conditions, injuries, or limitations
• If you experience pain, discomfort, or injury, stop training immediately and seek medical attention

Insurance

Blue Devil Jiu Jitsu does not provide health or medical insurance for members. You are responsible for maintaining adequate health insurance coverage.

6. Liability Waiver and Release

By using our services, you agree to release, waive, discharge, and covenant not to sue Blue Devil Jiu Jitsu, its owners, instructors, employees, and affiliates from any and all liability for injuries, damages, or losses arising from your participation in training activities, whether caused by negligence or otherwise, to the fullest extent permitted by law.

7. Photography and Media Release

By participating in classes or events, you consent to being photographed, filmed, or recorded for promotional purposes, including use on our website, social media, and marketing materials. If you do not wish to be featured, please notify us in writing.

8. Intellectual Property

All content on our website, including text, graphics, logos, images, videos, and software, is the property of Blue Devil Jiu Jitsu and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our express written permission.

9. Termination of Membership

We reserve the right to terminate or suspend your membership at any time, with or without cause, including but not limited to:

• Violation of these Terms of Service or facility rules
• Disrespectful or unsafe behavior
• Non-payment of fees
• Providing false or misleading information

No refunds will be issued for memberships terminated due to rule violations.

10. Limitation of Liability

To the maximum extent permitted by law, Blue Devil Jiu Jitsu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use our services
• Injuries or damages sustained during training
• Any unauthorized access to or use of our servers or personal information

11. Indemnification

You agree to indemnify, defend, and hold harmless Blue Devil Jiu Jitsu, its owners, instructors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including attorney's fees) arising from:

• Your violation of these Terms of Service
• Your use of our facilities or services
• Your violation of any third-party rights

12. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration in Macomb County, Michigan, or through the courts of Macomb County, Michigan.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of significant changes by posting the updated terms on our website with a new "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the updated terms.

14. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices or agreements, constitute the entire agreement between you and Blue Devil Jiu Jitsu regarding your use of our services.
